Any typographical, clerical or other accidental errors or omissions in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.
The Photographer shall not be liable to the Customer for any failure, in whole or in part, to fulfil their obligations under an Order where failure arises as a result of an event or circumstances beyond his control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.
The Photographer shall be entitled to sub-contract his obligations under an Order at their discretion.
The provisions of these Terms and Conditions are in addition to and do not affect the Buyer’s statutory rights as a consumer.
Confidentiality
We respect your confidentiality; your personal information, contact details and payment information will not be shared with any other company. Please see our privacy policy for how we handle your data.
Deposits & Payment Terms
Payment can be made through a number of methods; we accept all major credit and debit cards, PayPal and cash.
Photo shoots that are re-scheduled less than 48 hours before the booked time will incur a 10% charge of the written quotation, paid on cancellation or added to their next scheduled photo shoot date.
Commercial Photography is invoiced with finished edited images; payment is expected on delivery with a 30 day grace period. The photographer shall deliver an invoice for the Price to the Customer and the Customer shall pay the Price (or any balance of it) within 30 days of the date of the invoice. Any sum outstanding after the expiry of 30 days shall have the following consequences; an interest rate of 3% per annum above the base rate of Lloyds TSB Bank plc shall accrue in respect of any outstanding sum after the 30 day period.
After 30 days in an overdue state, the photographer reserves the right to apply a £40 late payment charge.
Health & Safety Policy
Zelda de Hollander Photography is fully insured for public and employee liability.
Zelda de Hollander Photography takes every reasonable effort to ensure the studio premises and equipment is deemed as suitable and safe for all users at all times. The Client is fully responsible for their own action, and responsible for the children they are in the accompany of, and any damages or breakages to the property that incur as a result of the Clients action shall be the responsibility of the Client to pay or rectify as agreed with Zelda de Hollander Photography. Photographic sessions can involve some physical activity, which is undertaken at your own risk.
We do not accept any responsibility for loss or damage to any personal belongings in or outside the studio premises.
We request that all clients advise of any special or medical requirements, including sensitivity to flashing lights, prior to the photo shoot booking.
Customer Online Albums
Our customer online albums are for viewing only; images are not to be saved, used or published without our prior consent and is classified as a breach of copyright and we reserve the right to remove your photographs from view.
Password Protected Customer Albums be online for a maximum of 45 days. After this time the album goes ‘offline’ and is no longer available to view or purchase from. If an online album is requested to be put back online, this is done at the photographer’s discretion, with the potential of an archival retrieval fee but it can also be refused.
We are not responsible for other parties viewing client albums and images who obtain passwords from any third party. We will not hand out login, password or booking information to anyone besides the client or any approved persons by this client.
Copyright
All images on this website are under the copyright of Zelda de Hollander. You may not sell, publish, licence, copy, store digitally or otherwise distribute any of these images without the written permission of the photographer.
Copyright in all Material is retained worldwide by the Photographer at all times and nothing shall be deemed as a release, transfer, assignment or other disposal of the Photographer’s rights in the Material.
The 1988 Copyright Act assigns the copyright of the photographs to The Photographer(s). It is therefore contrary to the Act, and illegal, to copy photographs, or allow to be copied, by any means photographic or otherwise, by any person or machine other than by The Photographer(s) or their appointed agents.
The Client shall not reproduce, in any form, including but not limited to photocopying, scanning, displaying on a computer, and on the internet images created by Zelda de Hollander Photography without prior written agreement and terms.
The Client agrees that Zelda de Hollander Photography has the unrestricted right and permission to copyright and use, re-use, publish, and republish photographic portraits or images produced for the Client made through any and all media for illustration, art, promotion, advertising, trade, or any other purpose whatsoever.
Image Retention, Archive & Destruction
The original digital files will be retained for a period of 6 months from the date of the sitting, they are then securely destroyed.
Liability
The Client will indemnify Zelda de Hollander Photography against all claims, liability, damages, costs and expenses, including legal fees and expenses as a result of use of images or images modified by the Client for which no permission was granted. If no release exists in writing then no release or permission exists.
The Client indemnifies Zelda de Hollander Photography against all claims, liability, damages and expenses incurred in connection with any third party claim arising out of the use of such material. The liability for any claim is limited to the total invoice amount.
Refund & Exchange Policy
Digital Images (including but not limited to ‘CDs of Images’, ‘USB sticks’ and ‘Electronic Transfers’), stock images and all downloadable imagery is non-refundable due to the nature of the product. Customers that purchase digital images, we cannot guarantee print quality from your own supplier.
Complaints or claims must be notified to us in writing as soon as possible. In the case of non-delivery, in a reasonable time after the good were expected to arrive. See our returns policy above.
